As of April 20, 2005, consumer bankruptcy attorneys are now required to perform a reasonable investigation of the information provided by a client attempting to file for bankruptcy. This requirement is a part of the new Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA), which attempts to make it more difficult for consumers to file for bankruptcy under Chapter 7, steering these consumers instead to file under Chapter 13.
ICS can provide these services to attorneys to satisfy this new requirement with a Bankruptcy Due Diligence investigation. This investigation is similar to a background investigation, but is tailored specifically for an attorney for use in filing a bankruptcy petition on a client's behalf under the new bankruptcy law. A report will be created identifying the liabilities of the client obtained from various databases, including credit reports and public records information.
