Counter Surveillance of Disability Fraud Investigation Case Study

A client won a lawsuit from a large corporation that resulted in her receiving disability benefits. It was approaching time to renew those benefits, and a hearing would be conducted in order to ascertain whether the client was still disabled and if she would be qualified for more funds.

The client believed that the corporation had hired a private investigator in order to conduct surveillance and verify the legitimacy of her disability. The client wanted to know if there was a way to verify her assumptions, and if she was in fact being followed. The client spoke with a case analyst at ICS and expressed her concerns. The case analyst determined during the free consultation that the most expedient course of action would be to conduct a counter-surveillance investigation.

A counter-surveillance investigation involves placing a private investigator on the client in an attempt to determine if the client is under surveillance by another subject. This enables investigators and the client to determine if there are any inconsistencies in a person’s behavior.

The investigator arrived at the client’s home and established visual contact in close proximity to her residence. The investigator positioned himself in an area out of sight to the untrained eye. Hourly documentation was made on video, and a verbal report was given to the Case Manager and to the client. The client had requested the counter-surveillance to take place during the times she felt she was being followed. The investigator spent ten hours following the client to various appointments and observing her residence. It is more common when conducting counter-surveillance investigations (if finances permit) to have multiple investigators involved over various times and various days. This helps break up the routine, and allows for a better chance of ascertaining whether a client is the subject of surveillance.

Conclusion:

The result of the counter-surveillance investigation proved that the client was indeed being followed. The private investigator dug deeper and learned that it was the corporation behind it all. This gave the client relief, knowing that she wasn't going crazy by thinking that someone was following her. This also made her aware of the fact that the corporation still had concerns about the possible disability fraud they believed she was committing.
